These terms govern the use of PasslyWallet, a product of GBICT, a sole proprietorship (Dutch Chamber of Commerce 92443389), based at W. Dreesweg 16, 1314 CL Almere, the Netherlands. By creating an account or using the service, you agree to these terms.
01The service
PasslyWallet provides a loyalty platform that lets businesses offer a loyalty card living in Apple Wallet and Google Wallet, plus a dashboard to manage members and points.
02Account and responsibilities
You are responsible for the accuracy of your account data and for keeping your credentials and API keys confidential.
When you enrol members, you are the controller of their data. You ensure a valid legal basis and the necessary consent, and use the service only lawfully.
03Subscription and payment
Use may be subject to a subscription under the plan and price then in effect. Prices and billing terms are disclosed at sign-up.
04Acceptable use
You will not use the service for unlawful, deceptive or harmful purposes, will not send unsolicited messages in breach of law, and will not attempt to bypass security or access others’ data.
05Data processing
For member data you are the controller and PasslyWallet acts as a processor. See our Privacy Policy; a data processing agreement is available on request.
06Availability
We aim for high availability but cannot guarantee uninterrupted service. Maintenance and incidents may cause temporary interruptions.
07Liability
The service is provided "as is". To the extent permitted by law, our liability is limited to direct damages and to the amount you paid for the service in the preceding twelve months.
08Term and termination
You can terminate your account at any time. On termination you may export your data; we then delete or anonymise it within a reasonable period.
09Changes
We may update these terms. For material changes we will notify you in advance. Continued use constitutes acceptance.
10Governing law
These terms are governed by Dutch law. Disputes are submitted to the competent Dutch court for the district where GBICT is established. Contact: info@passlywallet.com.
